Subscription Terms and Conditions Of Use

By completing the subscription process, you expressly agree to be bound by the terms and conditions below, the ASAP Privacy Policy, and any other terms, conditions, notices and disclaimers displayed elsewhere on the ASAP Index web site.

If you object to these terms and conditions or any subsequent modifications to them, or become dissatisfied with your subscription to the ASAP in any way, you should immediately:
  • discontinue your use of the ASAP; and
  • terminate your subscription by notifying ASAP in writing

Subscription Information

When subscribing to ASAP, you must provide ASAP with accurate, complete and up-to-date information as requested. It is your responsibility to inform ASAP of any changes to that information. You may do this at any time by going to Contact on the ASAP Index web site.

All personal information you provide ASAP as a member will be treated in accordance with the ASAP Privacy Policy below.

Username and Password

When you subscribe to ASAP, you will create your own username and a password. You must ensure that these remain confidential at all times since you are entirely responsible for all activities which occur under your username and password, including unauthorised use of your or any other credit card. You must notify ASAP immediately if you become aware of any unauthorised use of your username and password.

Each username and password must be used by a single user and is not transferable.

Each subscription allows one user to access the ASAP Index. Any breach of this term will result in termination of your access to the ASAP Index.

Any use of the ASAP Index with the assistance of any automated scripting tool or software is strictly prohibited.

Use of all ASAP information is strictly for personal use only and must not be reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means without the prior written approval of ASAP.

Termination and alterations

ASAP may at its discretion terminate your subscription of, or access to, the ASAP Index at any time. If this happens we will notify you.

In such event:
  • You are no longer authorised to access the ASAP Index;
  • You will continue to be subject to and bound by all restrictions imposed on you by these terms and conditions, and all disclaimers by ASAP and limitations of ASAP'S liability set out in these terms and conditions or elsewhere on the ASAP Index will survive.
Updating the ASAP Index

ASAP may change or discontinue any feature of the ASAP Index including content, hours of availability and equipment required for access.

ASAP may change and update these terms and conditions, or the ASAP Index Privacy Policy at any time. Updated versions of these documents will be posted on the ASAP Index. You are responsible for ensuring that you regularly review these documents. Your continued use of the ASAP Index after any such changes are made will be deemed to constitute your acceptance of those changes.

ASAP Index Conditions of Use

These terms together with any additional terms, conditions, notices and disclaimers contained elsewhere on the ASAP Index form the conditions of supply of material on, use of and access to the ASAP Index. Your continued use of the ASAP Index constitutes an affirmative, acknowledgment and agreement by you that you accept and agree to abide and be bound by these conditions and any modifications.

The ASAP Index (ASAP)

The web site which forms the 'ASAP Index' is operated by ASAP Index, referred to as 'ASAP'.

These Conditions of Use govern your use of the ASAP Index.

From time to time, ASAP may run competitions, prize draws and promotions on the ASAP Index. These will be subject to additional terms and conditions, which will be made known to you at the time.

Accuracy of information and disclaimer of warranties

All material on the ASAP Index is provided in good faith. It is derived from sources believed to be accurate and current as at the date of publication. Your use of the ASAP Index is at your sole risk. Access to the ASAP Index is provided on an 'as available' basis. Neither ASAP its related bodies corporate nor its or their directors or employees make any representation or warranty that (i) any material on the ASAP Index will be reliable, accurate or complete (nor do they accept any responsibility arising in any way for errors in, or omissions from that material); or (ii) your access to the ASAP Index will be uninterrupted, timely or secure. ASAP will not be liable for loss resulting from any action or decision by you in reliance on the information on the ASAP Index, nor any interruption, delay in operation or transmission, virus, communications failure, Internet access difficulties, or malfunction in equipment or software.

The material on the ASAP Index provides general information only. It is not intended as advice and must not be relied upon as such. You should make your own inquiries and take independent advice tailored to your specific circumstances prior to making any decisions.

Copyright

All material including, but not limited to, all formats, charts, report layouts, ratings, margins and value prices, provided on the ASAP Index is copyright protected. You may use this material for your own personal reference only. Except for the temporary copy held in the computer's cache and a single permanent copy for your personal reference, the material may not otherwise be used, copied, reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means in whole or part (except where such use constitutes fair dealing under the Copyright Act) without the prior written approval of ASAP.

You may not use any part of the material on the ASAP Index site to establish, maintain or provide, or assist in establishing, maintaining or providing your own publications, Internet site or other means of distribution.

Trademarks and property

The ASAP logo, the logo's of the ASAP site and the mastheads on the ASAP Index site are the property and trademarks of ASAP. Other trade marks may be displayed on the ASAP Index from time to time. These may belong to third parties. Nothing displayed on the ASAP Index grants any licence or right of use, without the express written permission of ASAP.

Your conduct

As a condition of your use of the ASAP Index or any services on the ASAP Index, you warrant to ASAP that you will not use the ASAP Index for any purpose that is unlawful or prohibited by these terms and conditions or any other terms, conditions or notices appearing anywhere on the ASAP Index. You agree to abide by all applicable laws and regulations.

In particular, you agree not to:
  • use any automated scripting tools or software;
  • engage in or promote any surveys, contests, pyramid schemes, chain letters, unsolicited e-mailing or spamming via the ASAP Index;
  • impersonate any person or entity;
  • upload, post, e-mail, transmit or otherwise make available using the ASAP Index any material that you do not have a right to make available under any law or contractual obligation or which contains viruses, or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware;
  • breach any applicable laws or regulations.

ASAP has no obligation to monitor any user's use of the ASAP Index, however ASAP retains the right at all times to monitor, retain and disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.

You will indemnify ASAP if ASAP or its related bodies corporate suffer any loss or damage or incur any costs in connection with any breach of these conditions or any other legal obligation by you or your use of or conduct on the ASAP Index.

Sports Information

ASAP believes that its sports information is accurate and timely, but ASAP and its suppliers do not warrant or guarantee such accuracy or timeliness. ASAP and its suppliers do not authorise the use of its 'sports information' or any other information on the ASAP Index for any purpose other than your personal use, and prohibit, to the maximum extent allowable, the resale, redistribution, and use of this information.

Third party links and advertising

Hyperlinks and pointers to websites operated by third parties may appear on the ASAP Index from time to time. These websites do not form part of the ASAP Index and are not under the control of ASAP and ASAP has no responsibility for the contents of any such hyperlink or linked website. If you link to any such websites you leave the ASAP Index and do so entirely at your own risk.

If you contact a third party using functionality provided on the ASAP Index, including via e-mail, ASAP accepts no responsibility for any actions taken by that third party in response to your communication or for any transactions entered into between you and the relevant third party.

Limitation of liability

ASAP excludes all conditions and warranties which may be implied by law.

To the extent permitted by law, ASAP's liability for breach of any implied warranty or condition which cannot be excluded is restricted, at ASAP's option, to:

in the case of services supplied or offered by ASAP:
  • the re-supply of those services; or
  • the payment of the cost of having those services re-supplied;
and in the case of goods supplied or offered by ASAP:
  • the replacement of the goods or the supply of equivalent goods;

You expressly agree and understand that in no circumstances will ASAP be liable to you for any indirect, incidental, special and/or consequential losses or damages or loss of profits of whatever nature howsoever arising (including but not limited to any act or omission by ASAP) which result from:
(i) the use of or access to or any inability to use or access the ASAP Index or any material on the ASAP Index;
(ii) unauthorised access to or alterations of your transmissions or data; or
(iii) statements or conduct of any third party on the ASAP Index. Excluding liability for negligence the maximum liability of ASAP is equivalent to the total of any amounts you have paid to ASAP and its related bodies corporate in respect of goods or services supplied to you by ASAP through the ASAP Index.

This policy sets out how ASAP uses your personal information

This policy applies to the ASAP Index, (ASAP). The policy explains how ASAP uses personal information collected through the ASAP Index.

ASAP may, from time to time, review and update this privacy policy statement to take account of new laws and technology and changes to ASAP's operations.

What kind of personal information ASAP collects and how it is collected?

In general, the personal information ASAP collects includes (but is not limited to) name, contact details, occupation or sports of interest, in some cases membership of professional or sports associations and sports clubs, where relevant, financial information, including credit card information and banking details (all protected by SSL Certificate).

We obtain most personal information through the ASAP subscription registration process and updates to subscription details. You may provide information when you subscribe to the ASAP Index, provide a product or service to ASAP, complete a survey or questionnaire, enter a competition, participate in forums or when you communicate with ASAP by e-mail or telephone.

Automatic collection: Cookies: We may use a feature of your browser called a cookie to assign your computer a 'User ID'. Cookies do not contain information by which ASAP can identify you. ASAP may use information it collects from you for the primary purpose for which it is collected and for such other secondary purposes that are related to the primary purpose of collection.

ASAP generally uses personal information to:

  • provide you with products or services you have requested;
  • personalise and customise your experiences on the ASAP Index;
  • help ASAP manage and enhance its services;
  • communicate with you;
  • provide you with ongoing information about opportunities on the ASAP Index in which ASAP believes you may be interested;

ASAP endeavours to ensure that the personal information it holds is accurate, complete and up to date. You can update your ASAP membership information by going to Contact on the ASAP site and sending any new details.

Where personal information is no longer required by ASAP, it will be destroyed or de-identified.

Seeking access to the personal information ASAP holds about you

You have the right to seek access to the personal information held about you and to advise ASAP of any inaccuracy.

If you make an access request, ASAP will ask you to verify your identity and specify what information you require. ASAP may charge a fee to cover the costs of meeting your request.
